Ordering & Shipping

This Ordering Policy was last updated on August 23, 2005.

By accessing and/or using www.YourDogWillDigIt.com (the “Web Site”), a web site that is owned and operated by Fetch LLC, a Texas limited liability company (“Fetch”), to purchase a product and/or service you are accepting the policies and practices described in this Ordering Policy. This Ordering Policy may change from time to time, so please check back periodically.

Please read this Ordering Policy carefully as it constitutes a valid, binding contract between you and Fetch. BY ORDERING MERCHANDISE AND/OR SERVICES VIA THE WEB SITE, YOU HAVE SIGNIFIED YOUR ACCEPTANCE OF THIS ORDEING POLICY, AS IT MAY BE AMENDED FROM TIME TO TIME. If you do not wish to be bound by this Ordering Policy, you are not authorized to access or use the Web Site and/or any of its components. Please print a copy of this Ordering Policy for your records.

This Ordering Policy is intended to supplement the Terms of Use Agreement. To the extent there is any conflict or contradiction between the Ordering Policy and the Terms of Use Agreement, the Ordering Policy shall take precedence and control.

SHIPPING
Our standard delivery time is seven (7) to fourteen (14) days for in-stock, non-serviced merchandise. Please note that merchandise shipped directly from our suppliers or oversized merchandise may take longer. Our shipping prices are based on the amount of the total purchase. Orders are charged in full upon first shipment of merchandise. Merchandise ordered together may not arrive in the same box.

In order to offer a wide selection of merchandise, many of our products are shipped from a number of different sources, and products are often shipped in a number of packages via Federal Express, UPS and/or the United States Postal Service. Many of our products are specialty made per order and may take additional time for delivery as indicated in the product description.

Shipping costs are as follows:

for orders up to $39.99, our shipping charge is $8.00;
for orders from $40.00 up $69.99, our shipping charge is $10.00;
for orders from $70.00 up to $99.99, our shipping charge is $12.00;
for orders from $100.00 up to $149.99, our shipping charge is $15.00;
for orders from $150.00 up to $299.99, our shipping charge is $20.00; and
for orders from $300.00 up, our shipping charge is $25.00.

PRODUCT DISPLAY
Fetch will make every effort to display the products and services featured on the Web Site as accurately as possible. Please note, however, that the colors used by Fetch, as well as the display and color capabilities of your particular computer monitor, will greatly affect the colors actually viewed on the computer monitor screen. The Web Site cannot be responsible for the limitations of your monitor’s display of any color, texture, or detail of actual merchandise.

PAYMENTS AND DISPUTED PAYMENTS
All payments must be made by VISA, MasterCard, or American Express. We currently do not accept cash, checks or any other payment form, although in the future we may change this policy. Your card issuer agreement governs your use of your designated card, and you must refer to that agreement and not this Agreement to determine your rights and liabilities as a cardholder. You, and not Fetch, are responsible for paying any unauthorized amounts billed to your credit card by a third party. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. Unless you notify Fetch of any discrepancies within sixty (60) days after they first appear on your credit card statement, you agree that they will be deemed accepted by you for all purposes. If Fetch does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Fetch or its agents. You are responsible for paying any governmental taxes imposed on your purchases, including, but not limited to, sales, use or value-added taxes. Fetch shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Texas and any other states or localities that it deems is required.

NON-RETURNABLE MERCHANDISE, EXCHANGES AND STORE CREDITS
If any Fetch purchase fails to meet your expectations, simply return your merchandise to us in its original and unused condition within fifteen (15) days of receipt for a full merchandise exchange or store credit, which will be available for a period of one (1) year. We encourage you to measure your pet as accurately as possible, as we will allow only one exchange per item. After one exchange, each additional exchange will incur a re-stocking and shipping and handling fee of $15.00.

OUR APOLOGIES, BUT WE DO NOT ISSUE REFUNDS. ALL SPECIAL ORDERS OR PERISHABLE ITEMS ARE FINAL SALES AND CANNOT BE EXCHANGED OR RETURNED.

HOW TO RETURN MERCHANDISE FOR EXCHANGE OR STORE CREDIT
Please send an e-mail stating both a reason for return and the product that you would like the merchandise to be exchanged for to returns@yourdogwilldigit.com to receive a return merchandise authorization number (the “RMA Number”). Upon receipt of a RMA Number, please ship the merchandise properly and safely packed via UPS, Federal Express, or United States Postal Service Mail with insurance and delivery confirmation to:
